Acceptable Use Policy

Acceptable Use Policy

  • spam of ongevraagde bulkberichten;
  • phishing, fraude, of misleiding van ontvangers;
  • malware, virussen, of andere schadelijke code;
  • het stelen of misbruiken van inloggegevens/tokens (van het platform, van derde diensten, of van derden);
  • intimidatie, bedreiging, of ongewenst contact met individuen;
  • onwettige discriminatie of het faciliteren daarvan;
  • misleidende imitatie van een andere persoon, organisatie of merk;
  • onrechtmatig scrapen van websites of gegevensbronnen van derden;
  • inbreuk op auteursrecht, merkenrecht of andere intellectuele-eigendomsrechten van derden;
  • schending van de privacy van derden of onrechtmatige verrijking/verzameling van persoonsgegevens;
  • onrechtmatige leadwerving of -verrijking (bijvoorbeeld via bronnen waarvoor u geen toestemming of rechtmatige grondslag heeft);
  • illegaal of hoogrisicovol AI-gebruik zoals nader omschreven in de AI Usage Policy;
  • het invoeren of laten verwerken van gezondheidsgegevens/PHI via het platform, tenzij vooraf uitdrukkelijk door ons goedgekeurd (zie de AI Usage Policy);
  • het omzeilen van het beleid van een gekoppelde derde partij (zoals Meta of het WhatsApp Business-beleid);
  • beveiligingstesten tegen het platform of gekoppelde diensten zonder onze voorafgaande schriftelijke toestemming;

Version 1.1 · effective since September 20, 2026

Acceptable Use Policy

Acceptable Use Policy

Version 1.1 — adds an explicit prohibition on having health data/PHI processed (section 1), unless specifically approved in advance.

This Acceptable Use Policy describes which use of the Nexus Cognito platform is not permitted. Violation may lead to suspension or termination of the Service (see the Terms and Conditions).

1. Generally prohibited use

It is not permitted to use the platform for:

  • spam or unsolicited bulk messages;
  • phishing, fraud, or misleading recipients;
  • malware, viruses, or other harmful code;
  • stealing or misusing credentials/tokens (of the platform, of third-party services, or of third parties);
  • intimidation, threats, or unwanted contact with individuals;
  • unlawful discrimination or facilitating it;
  • misleading impersonation of another person, organisation or brand;
  • unlawful scraping of third-party websites or data sources;
  • infringement of copyright, trademark or other intellectual property rights of third parties;
  • violating the privacy of third parties or unlawful enrichment/collection of personal data;
  • unlawful lead acquisition or enrichment (for example via sources for which you have no consent or lawful basis);
  • illegal or high-risk AI use as further described in the AI Usage Policy;
  • entering or having health data/PHI processed through the platform, unless we have specifically approved this in advance (see the AI Usage Policy);
  • circumventing the policy of a connected third party (such as Meta or the WhatsApp Business policy);
  • security testing against the platform or connected services without our prior written consent;
  • any other use that harms the platform, other customers, or the reputation of connected providers.

2. WhatsApp-specific

You may use the platform exclusively to approach contacts via WhatsApp for whom you have a lawful basis for contact (see the Privacy Policy/DPA). The mere fact that you have stored a telephone number does not automatically constitute consent to message that person. The platform respects existing opt-outs: an earlier opt-out always outweighs a later existing consent, until the recipient explicitly gives consent again. You are yourself responsible for compliance with Meta's WhatsApp Business policy, including the rules around the 24-hour service window and approved message templates.

3. E-mail-specific

You are yourself responsible for a lawful basis to approach an e-mail address — the mere fact that an e-mail address is stored with us does not automatically make marketing messages to it lawful. Every e-mail sent through the platform contains a working unsubscribe link; it is not permitted to remove or hide it, or to ignore unsubscribe requests.

4. Review Automation-specific

It is not permitted to use the platform to manipulate reviews, including: selectively forwarding only positive feedback to a public review platform ("review gating"), encouraging or fabricating fake reviews, or offering an incentive for a review in a way that violates the policy of the review platform concerned. The platform's review landing page always shows both the external review option and the internal feedback option, regardless of the recipient's sentiment — this behaviour may not be circumvented or imitated in a way that does in fact filter on sentiment.

5. Lead Generator-specific

Sources of lead data must be lawful. It is not permitted to collect or enrich personal data in a way that violates the GDPR or the policy of the source from which the data originates. You remain responsible for human review of AI-generated lead analyses and outreach drafts before sending, and for excluding unlawful or discriminatory profiling.

6. Compliance with provider policies

To the extent your use of the platform depends on a connected third party (Meta, WhatsApp Business Platform, Mollie, or others), you are bound by that third party's own policy, in addition to this Acceptable Use Policy.

7. Enforcement

In the event of a suspected violation we may restrict functionality, remove content, or suspend or terminate the Service in accordance with the Terms and Conditions.

8. Contact
